These HiBob AI Terms (“AI Terms“) govern Customer’s access and use of any HiBob AI Feature and form a part of and are incorporated into the Customer Subscription Terms and Conditions or any other agreement entered into by and between HiBob and Customer (“Agreement“). Capitalized terms not defined herein shall have the meanings assigned to such terms in the Agreement.
HiBob allows you to fully operate the Bob platform without the use of the HiBob AI features, and you may choose to opt in or out at any time.
1.1. “HiBob AI Feature” means any of HiBob’s or a third party’s artificial intelligence or machine learning technology that is made available as part of the in-platform Services.
1.2. “Input” means any data, which may include Customer Data, provided by Customer to HiBob to be processed by a HiBob AI Feature.
1.3 “Output” means responses, content, or suggestions generated by a HiBob AI Feature and presented to the Customer through the HiBob Services.
1.4 ”AI Service Providers״ means the third-party service providers that HiBob utilizes to provide the HiBob AI Features, as listed on HiBob’s Sub-Processors page.
2.1 Customer Data processed by HiBob AI Features is not used to train artificial intelligence models. Input is processed by HiBob and its AI Service Providers solely for the purpose of providing the specific HiBob AI Feature requested by the Customer and its respective Outputs.
2.2 HiBob implements appropriate technical and organizational measures to protect Customer Data processed through HiBob AI Features. These measures include system controls and data handling procedures designed to minimize access to and retention of Customer Data, with the goal of protecting against unauthorized processing, disclosure, or access during HiBob AI Features-related processing activities.
2.3 HiBob utilizes artificial intelligence Service Providers to provide the HiBob AI Features. HiBob does not permit AI Service Providers to improve or train any of their artificial intelligence or machine learning models with Customer Data.
3.1 Due to the nature of artificial intelligence technologies, Customer remains solely responsible for its use of any HiBob AI Features, including: (i) ensuring that its use of any HiBob AI Features complies with the Agreement and all applicable laws and regulations (ii) establishing and enforcing internal policies on appropriate use and training Authorized Users and other relevant personnel on those policies; (iii) providing appropriate notice and transparency and obtaining all consents required by applicable laws; (iv) not using the HiBob AI Features in any manner that leads to discrimination or that creates content that is harmful, harassing, fraudulent, or defamatory, or otherwise violates any applicable law, company policy, or the rights of any third party; and (v) maintaining adequate human review and oversight of any use of the HiBob AI Features and resulting Output. Customer acknowledges and agrees that Output is generated by probabilistic systems and may include inaccuracies or errors; may reflect bias, lack of fairness, or limitations in underlying models or data; and may contain content that Customer or its Authorized Users consider unsafe, harmful, or otherwise objectionable; and may not be unique and could be identical or substantially similar to output generated for other customers. Customer acknowledges that the HiBob AI Features are optional components of the Services, and that Customer may stop using the HiBob AI Features at any time by disabling the HiBob AI Features through the administrative controls available to it within the Services.
4.1 HiBob AI Features are provided “as is” without any further warranties or conditions of any kind. Any express or implied warranties are excluded (including, but not limited to, any warranties or conditions of merchantability, satisfactory quality, fitness for a particular purpose, durability, suitability for specific requirements, except to the extent that any warranties by law cannot be validly waived or excluded), as well as any intellectual property rights that may be associated with any content generated by these features. The Customer acknowledges that HiBob AI Features are provided on an optional basis and may be discontinued at any time.
4.2. HiBob AI Features are powered by artificial intelligence and machine learning technologies that may, from time to time, generate output that is inaccurate, incomplete, or otherwise not aligned with a Customer’s specific needs, expectations, or applicable legal, regulatory, or compliance requirements. The Customer acknowledges that the use of HiBob AI Features is solely at its own risk.
4.3. HiBob disclaims any liability for inaccuracies, biases, or other limitations inherent in the underlying algorithms or data, and shall not be held responsible for any output that a Customer or its users may find unsafe, harmful, or offensive. Customer acknowledges that it is responsible for evaluating and verifying any Output.
5.1 HiBob reserves the right to suspend or terminate access to HiBob AI Features at any time if: (i) Customer violates these AI Terms or the Agreement; (ii) HiBob reasonably believes that the HiBob AI Features are being used in a manner that may cause legal liability for HiBob; or (iii) HiBob decides to discontinue the HiBob AI Features in whole or in part, for any reason.
6.1 HiBob may modify or replace these AI Terms from time to time. HiBob will provide notice of any material changes in accordance with the Agreement. Customer’s continued use of Al Features following any changes to the AI Terms, once posted to HiBob’s website or otherwise communicated to Customer, constitutes acceptance of those changes.
7.1 These AI Terms, together with the Agreement (including any Order Form incorporated herein and any exhibits or attachments) constitute the entire agreement of the parties relating to the subject matter hereof and supersede all prior or contemporaneous communications, understandings, and agreements, oral or written, relating to such subject matter.
