Subscription to the Services includes access to the Customer and its Authorized Users to HiBob’s “eSign” feature. If you choose to use HiBob’s eSign Feature (as defined below), you hereby acknowledge and agree to the terms stated in in these terms, which are in addition and subject to the terms separately agreed by you (the Customer or authorized User, respectively) and HiBob.
Each time you sign a document using the eSign Feature you agree to use of the feature for purposes of executing such a document in electronic transmission. If you are using the eSign Feature for executing a specific document your consent applies to the subject matter of that particular document.
An Authorized User may choose not to use the eSign Feature. If chosen to sign the document through alternative means, such as manually, then do not use the eSign Feature to send the document to the other party.
HiBob provides you with the option to download and print a paper copy of the executed document. If you later revoke your consent to use of the eSign Feature, please notify the sender and stop using the eSign Feature. PLEASE NOTE THE DECISION TO STOP USING THE ESIGN FEATURE DOES NOT APPLY FOR DOCUMENTS THAT YOU HAVE PREVIOUSLY EXECUTED USING THE ESIGN FEATURE.
Once a document signed electronically using the eSign Feature all rights and duties set forth in the document are solely of the signing parties. HiBob is not part of such documents and has no responsibility for the accuracy, validity, or compliance of the document. Furthermore, HiBob has no responsibility for the legal or illegal aspects of the document or any disputes that arise related thereto.
ANY STATEMENT HEREIN OR ELSEWHERE REGARDING THE VALIDITY OF ELECTRONIC SIGNATURE ARE FOR INFORMATIONAL PURPOSES ONLY. THEY ARE GENERAL IN SCOPE AND SHOULD NOT BE CONSTRUED AS LEGAL ADVICE. HIBOB SHALL NOT BE RESPONSIBLE FOR ENSURING THE DOCUMENTS ELECTRONICALLY SIGNED USING THE ESIGN FEATURE ARE VALID OR ENFORCEABE UNDER APPLICABLE LOCAL LAWS. YOU SHOULD CONSULT YOUR LEGAL ADVISOR REGARDING THE VALIDITY OR ENFORCEABILITY OF THE DOCUMENTS THAT WILL BE SIGNED USING THE ESIGN FEATURE.
The eSign Feature is valid under eIDAS regulation. However, please note that this is not a digital signature service. Digital signatures are codes embedded in files, to detect unauthorized changes to data and to verify the identity of the signee. They usually rely on encryption technology, which ensures that a document or a file has not been copied or altered without authorization. The eSign Feature, on the other hand, is only a way to indicate consent/approval or acknowledgment. Please note that the eSign Feature may not be legally enforceable in certain jurisdictions. Customer should assess the legality and enforceability of the use of this feature in their applicable jurisdictions.

Without derogating from the other use restrictions you are subject to, the following use restrictions apply in use of the eSign feature (including any SDK related thereto (the “eSign Feature”) and agree that you:
a) will use the eSign Feature only as an integral component of the Platform and only for the purposes described herein;
b) will not use the eSign Feature for development, compilation, debugging and similar design-time purposes;
c) will not reverse-compile or decompile, analyze, reverse-engineer, reverse-assemble or disassemble, unlock or otherwise attempt to discover the source code or underlying algorithms of the eSign Feature or attempt to do any of the foregoing in relation to the object code of the SDK; and
d) will not modify, adapt, translate or create any derivative works of the SDK or merge the eSign Feature or any part thereof into any other software.
e) will not use, copy, modify, or transfer the eSign Feature or any part thereof, or any copy, adaptation, transcription, or merged portion thereof, except as expressly permitted by the PDFTron.
Your rights will be non-exclusive and except as expressly permitted by the HiBob, non-assignable, provided always, however, that the relevant provisions set herein shall also apply to any permitted assignee or successor.
THE ESIGN FEATURE AND SDK IS PROVIDED “AS IS” WITHOUT ANY OTHER WARRANTIES OR CONDITIONS OF ANY KIND. ANY OTHER EXPRESS OR IMPLIED WARRANTIES ARE EXCLUDED (INCLUDING, BUT NOT LIMITED TO, ANY WARRANTIES OR CONDITIONS OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, SUITABILITY FOR LICENSEE’S REQUIREMENTS OR ARISING FROM ACOURSE OF DEALING, USAGE OR TRADE PRACTICE) EXCEPT TO THE EXTENT THAT ANY WARRANTIES IMPLIED BY LAW CANNOT BE VALIDLY WAIVED OR EXCLUDED. PDFTRON DOES NOT WARRANT THAT USE OF THE ESIGN FEATURE WILL BE ERROR-FREE OR THAT USE OF THE ESIGN FEATURE WILL MEET YOUR NEEDS.
Nothing in this statement shall derogate from anything in any End Users Terms of Use or Agreement executed between you (the Authorized User or Customer, respectively) and HiBob.
